МОВНІ ПРАВА ОСОБИ З ПОГЛЯДУ ЮРИДИЧНОЇ ЛІНГВІСТИКИ

Abstract

У статті запропоновано розширений поглѐд на зміст і обсѐг понѐттѐ "мовні права особи" з урахуваннѐм тих чітко не артикульованих прав, ѐкі логічно випливаять із засадничих правових принципів і де-факто захищаятьсѐ низкоя не-власне-мовних законів. З використаннѐм когнітивного моделяваннѐ обґрунтовано принципове право особи на ѐкісне офіційне мовленнѐ ѐк таке, що виводитьсѐ ѐк логічний наслідок з передбаченої принципом верховенства права концепції яридичної визначеності закону.

The article offers an expanded treatment of the notion of language rights of a person including the rights yet not worded explicitly in the legislative acts directly addressing the issues of language policy. There is a variety of the linguistically mediated rights protected by the legislation addressing other than language policy issues. The right of a person for qualitative official speech as one of the basic preconditions of the juridical principle of legal certainty is argued and cognitive modeling as an instrument of its justification is discussed
