Принцип поділу влади: організаційно-правовий вимір

Abstract

У кваліфікаційній роботі зроблено аналіз принципу поділу влади, встановлено його сутність та моделі. Автором охарактеризовано сутність принципу концепції стримувань і противаг як умови реалізації принципу поділу влади. Встановлено особливості розподілу влади між законодавчою, виконавчою та судовою владами. Розкрито суть та місце президентської влади в системі розподілу влади. Охарактеризовано проблеми поділу влади в Україні та шляхи їх вирішення. In the qualification work the analysis of the principle of separation of powers is made, its essence and models are established. The author describes the essence of the principle of the concept of checks and balances as a condition for the implementation of the principle of separation of powers. The peculiarities of the division of power between the legislative, executive and judicial authorities have been established. The essence and place of presidential power in the system of distribution of power are revealed. Problems of separation of powers in Ukraine and ways to solve them are described.
