ПРОБЛЕМНІ ПИТАННЯ СПІВУЧАСТІ В КРИМІНАЛЬНОМУ ЗАКОНОДАВСТВІ: ДОСВІД УКРАЇНИ ТА КРАЇН ЄС

Abstract

Кваліфікаційна робота присвячена дослідженню поняття та ознак співучасті за кримінальним законодавством України та кримінальним правом провідних країн ЄС. В ході дослідження було проаналізовано історію становлення та розвитку інституту співучасті як складової кримінально-процесуальної науки та практики. Автор звертає увагу на форми (види) співучасті та надає їх загальну характеристику, зіставляючи із подібними правовими явищами в кримінальному законодавстві та науці зарубіжних країн. Окрема увага приділена видам співучасників та проблемами розмежування їх кримінальної відповідальності за законодавством України та країн ЄС. Також автором ореслено перспективи удосконалення інституту співучасті з урахуванням досвіду країн ЄС. Qualification work is devoted to the study of the concept and features of complicity in the criminal law of Ukraine and the criminal law of leading EU countries. In the course of the research the history of formation and development of the institute of complicity as a component of criminal procedure science and practice was analyzed. The author draws attention to the forms (types) of complicity and provides their general characteristics, comparing them with similar legal phenomena in criminal law and science of foreign countries. Particular attention is paid to the types of accomplices and the problems of delimitation of their criminal liability under the laws of Ukraine and EU countries. The author also outlines the prospects for improving the institution of complicity, taking into account the experience of EU countries.
