АЛГОРИТМ ДІЇ ЛІКАРЯ ПРИ ВИЯВЛЕННІ ВИПАДКІВ ДОМАШНЬОГО НАСИЛЬСТВА ТА ДОКУМЕНТУВАННІ

Метою статті став аналіз і узагальнення рекомендацій щодо алгоритму дій медичних працівників при документуванні випадків домашнього насильства (фізичного, сексуального, психологічного, економічного) та надання медичної та психологічної допомоги постраждалим особам з дотриманням прав пацієнтів та забезпеченням їх безпеки. Матеріали та методи. Огляд нормативно-правових документів та науково-методичних публікацій в міжнародних електронних наукометричних базах даних PubMed, Embase і Scopus за ключовими словами. Результати. В зв’язку зі збільшенням випадків домашнього насильства в умовах збройного конфлікту в Україні, питання запобігання та протидії домашньому насильству, своєчасної фіксації та документування ушкоджень та наслідків насильства, потребує постійної особливої уваги. В Україні розроблена та постійно вдосконалюється система заходів щодо запобігання, протидії та профілактики насильства. Медичні працівники під час звернення по медичну допомогу постраждалих від домашнього насильства осіб або їх законних представників повинні зафіксувати їх скарги, зібрати анамнез, провести медичний огляд з фіксацією та документуванням тілесних ушкоджень, оцінкою стану постраждалої особи, в разі потреби призначити додаткове інструментально-лабораторне обстеження, надати кваліфіковану медичну допомогу. Заклад охорони здоров’я не пізніше однієї доби має інформувати з дотриманням правового режиму інформації з обмеженим доступом уповноважені підрозділи органів Національної поліції України про виявлення факту домашнього насильства. Висновки. В Україні, на законодавчому рівні, постійно вдосконалюється система заходів щодо запобігання, протидії та профілактики домашнього насильства. Важливу роль для проведення своєчасного фіксування та документування випадків домашнього насильства з дотриманням прав та забезпеченням безпеки постраждалих відіграє залучення медичних працівників. Медичним працівникам в доступній формі, для постраждалих від домашнього насильства особам, завжди необхідно роз′яснити, що перелічені вище кроки допоможуть зібрати докази факту домашнього насильства, документуванню і запобіганню подальшого здійснення домашнього насильства, а також подоланню негативних наслідків і впливів домашнього насильства на фізичне та психологічне здоров’я. Abstract. The purpose article is an analysis and generalization of recommendations regarding the algo- rithm of actions of medical workers when documenting cases of domestic violence (physical, sexual, psychologi- cal, economic) and providing medical and psychological assistance to victims while respecting the rights of patients and ensuring their safety. Materials and methods. Review of regulatory documents and scientific and methodological publications in the international electronic scientometric databases PubMed, Embase and Scopus by keywords, research and analysis of 120 medical records of inpatient and outpatient patients for the period 2019-2023. Results. In recent years, in the conditions of the international armed conflict on the territory of Ukraine, constant shelling and air strikes, great psycho-emotional burden on the population due to the threat to their lives and the uncertainty of the situation, there has been an increase in cases of physical, psychological and sexual violence, in particular cases of domestic violence. In connection with the increase in cases of domes- tic violence in the conditions of the armed conflict in Ukraine, the issue of prevention and counteraction of do- mestic violence, timely recording and documentation of injuries and consequences of violence, requires constant special attention. In Ukraine, a system of measures to pre- vent, counter and prevent violence has been developed and is constantly being improved. When applying for medical assistance of persons affected by domestic violence or their legal representatives, medical workers must record their complaints, collect anamnesis, conduct a medical ex- amination with recording and documentation of bodily in- juries, assess the condition of the victim, and, if necessary, prescribe additional instrumental and laboratory examina- tion. provide qualified medical assistance. The health care institution must inform the authorized divisions of the Na- tional Police of Ukraine about the discovery of the fact of domestic violence no later than one day in compliance with the legal regime of information with limited access. When providing medical, psychological, and le- gal assistance, it is important for specialists of all fields to remember that the right to appeal to state bodies, health care institutions, human rights organizations, and psy- chologists for assistance to victims of domestic violence (physical, sexual, psychological, etc.) - this is a personal decision of each affected person. However, it is always im- portant to make it clear to all victims of domestic violence that the steps listed above will help gather evidence of the crime in case the victim changes their mind and dares to report it later. Conclusion. In Ukraine, at the legislative level, the system of measures to prevent, counteract and prevent domestic violence is constantly being improved. The in- volvement of medical professionals plays an important role in the timely recording and documentation of cases of domestic violence while respecting the rights and ensuring the safety of the victims. It is always necessary to explain to medical professionals in an accessible form, for victims of domestic violence, that the steps listed above will help to collect evidence of the fact of domestic violence, to doc- ument and prevent further domestic violence, as well as to overcome the negative consequences and effects of do- mestic violence on physical and psychological health.
АЛГОРИТМ ДІЇ ЛІКАРЯ ПРИ ФІКСАЦІЇ СЕКСУАЛЬНОГО НАСИЛЬСТВА ПІД ЧАС ЗБРОЙНИХ КОНФЛІКТІВ ТА ВОЄННОГО СТАНУ В УКРАЇНІ

Мета - аналіз і узагальнення рекомендацій щодо дії медичних працівників при документування фактів сексуального насильства та надання медичної та психологічної допомоги особам, постраждалим від сексуального насильства, пов′язаного зі збройним конфліктом в Україні. Результати. Внаслідок міжнародного збройного конфлікту на території України, викликаного агресією Російської Федерації, зафіксовано велику кількість злочинів проти цивільного населення. На теперішній час одним зі складних викликів суспільства є сексуальне насильство в умовах збройного конфлікту. Сучасним інструментом боротьби з насильством проти жінок та запобігання насильства стосовно жінок стала Стамбульська конвенція. Сексуальне насильство під час збройного конфлікту є не лише кримінальним злочином, а й порушенням міжнародного гуманітарного права та прав людини. За даними ООН факти сексуального насильства в умовах війни складно виявити та розслідувати. Реагування на сексуальне насильство в умовах збройного конфлікту потребує координації міжнародних та національних інституцій та міжгалузевого підходу з надання правової та медичної допомоги, соціально-психологічної підтримки постраждалим від сексуального насильство під час збройного конфлікту. Важливо проводити своєчасне фіксування та документування злочинів, свідками чи постраждалими від яких ви стали, та збирати максимум доказів для притягнення винних до відповідальності. Важливим аспектом є те, що право на звернення постраждалих від сексуального насильства осіб при збройних конфліктах до державних органів, правозахисних організацій, медичних працівників, психологів за допомогою - це особисте рішення особисто кожної постраждалої особи. Постраждала від сексуального насильства в умовах збройного конфлікту особа має право на отримання кваліфікованої безоплатної медичної допомоги. Висновки. Рекомендовано алгоритм дій для медичних працівників у випадках фіксації та документування факту сексуального насильства, пов’язаного з конфліктом. Для запобігання психологічної травматизації потерпілої особи рекомендовано застосування сучасних способів фіксації (фотографування, відеозйомка) під час збору анамнезу і подальшому огляді потерпілої особи з метою можливості використання отриманих даних сторонами кримінального провадження/суду. Своєчасне проведення судово-медичних експертиз з метою виявлення наявності ушкоджень із подальшою фіксацією фактів сексуального насильства, пов’язаного з конфліктом допоможе стороні кримінального провадження/суду вжити ефективні заходи кримінального або іншого характеру стосовно кривдника. The purpose of the study was to analyze and generalize recommendations regarding the ac- tions of medical workers when documenting the facts of sexual violence and providing medical and psycholog- ical assistance to persons affected by sexual violence related to the armed conflict in Ukraine. Results and discussion. As a result of the international armed conflict on the territory of Ukraine, caused by the aggression of the Russian Federation, a large number of crimes against the civilian population were recorded. At the present time, one of the difficult challenges of society is sexual violence in the conditions of armed conflict. Sexual violence during an armed conflict is not only a criminal offense, but also a violation of international humanitarian law and human rights. According to the United Nations, the facts of sexual violence in wartime are difficult to detect and investigate. Responding to sexual violence in armed conflict requires coordination of international and national institutions and an interdisciplinary approach to providing legal and medical assistance, social and psychological support to victims of sexual violence during armed conflict. The modern tool for combating violence against women and preventing violence against women is the Istanbul Convention. An important aspect is that the right of victims of sexual violence during armed conflicts to appeal to state bodies, human rights organizations, medical workers, psychologists for help is a personal decision of each victim. A victim of sexual violence in the context of an armed conflict has the right to receive qualified free medical care. Medical assistance to persons affected by conflict-related sexual violence is provided in health care facilities as needed at all levels of medical care, both outpatient and inpatient. The purpose of providing medical assistance to the victim is to overcome the negative consequences and effects of conflict-related sex- ual violence on the physical and psychological health of the victim. The injured person has the right to freely choose a health care facility, a doctor, and a method of treatment in accordance with the doctor’s recommen- dations. Medical assistance to persons affected (or likely to be affected) by conflict-related sexual violence is provided in accordance with the Protocols for the provision of medical assistance. When seeking medical help from victims or their legal representatives, medical workers must record their complaints (appeals), collect anamnesis, conduct a medical examination with an assessment of the condition of a victim of conflict-related sexual violence and, if necessary, additional instrumental and laboratory examination and measures to pre- vent the consequences of sexual violence. Conclusion. We recommend an algorithm of actions for medical professionals in cases of recording and documenting the fact of conflict-related sexual violence. In order to prevent psychological traumatization of the victim, it is recommended to use modern methods of recording (photographing, video recording) during the collection of anamnesis and subsequent examination of the victim in order to enable the parties to the crim- inal proceedings/court to use the obtained data. It is emphasized that the timely conduct of forensic medical examinations in order to detect the presence of injuries with the subsequent recording of the facts of the con- flict-related sexual violence will help the side of the criminal proceedings/court to take effective measures of a criminal or other nature against the offender.
