    РЕФОРМУВАННЯ КРИМІНАЛЬНОГО ЗАКОНОДАВСТВА УКРАЇНИ У СФЕРІ ПРОТИДІЇ ЕКСПЛУАТАЦІЇ ЛЮДИНИ НА ОСНОВІ СТАНДАРТІВ МІЖНАРОДНОГО КРИМІНАЛЬНОГО ПРАВА: МІЖДИСЦИПЛІНАРНА МОДЕЛЬ ДОКТРИНАЛЬНОЇ РЕФОРМИ

    Актуальність теми. В умовах збройної агресії проти України особливої ваги набуває необхідність перегляду чинного кримінального законодавства у сфері протидії експлуатації людини відповідно до міжнародних стандартів, зокрема практики Міжнародного кримінального суду та Європейського суду з прав людини. Зростання випадків системного сексуального та трудового поневолення цивільного населення в умовах збройного конфлікту вимагає нормативного реагування, що ґрунтується на міжна- родно визнаних правових засадах. Мета. Метою дослідження є формування доктринальної моделі реформування кримінального законодавства України, що передбачає гармонізацію з практикою Міжнародного кримінального суду та Європейського суду з прав людини у частині кваліфікації експлуатаційних правопорушень, з ураху- ванням контексту збройного конфлікту. Методи. У дослідженні застосовано компаративний, системно-структурний та формально-юри- дичний методи, що дозволили зіставити положення Кримінального кодексу України з міжнародними кримінально-правовими стандартами, а також проаналізувати правозастосовну практику Міжна- родного кримінального суду та Європейського суду з прав людини щодо експлуатації особи. Результати. На основі індикативних матриць встановлено, що чинна редакція ст. 438 КК України не забезпечує належного охоплення воєнних злочинів, пов’язаних з експлуатацією. Визначено необхід- ність запровадження Концепції адаптації Кримінального кодексу України до вимог Римського ста- туту та Конвенції про захист прав людини. Висновки. Запропонована модель реформування дозволяє посилити кримінально-правові гаран- тії захисту особи, зменшити ризики порушень Конвенції у національній правозастосовній практиці та забезпечити інтеграцію України в європейський і міжнародний правовий простір. Relevance of the Topiс. In the context of armed aggression against Ukraine, the need to revise current criminal legislation in the field of combating human exploitation in accordance with international standards has become increasingly urgent, particularly with regard to the jurisprudence of the International Criminal Court and the European Court of Human Rights. The growing incidence of systemic sexual and labor enslavement of civilians during armed conflict necessitates a normative response grounded in internationally recognized legal principles. Purpose. The aim of the study is to develop a doctrinal model for reforming Ukraine’s criminal legislation, which would ensure its harmonization with the practice of the International Criminal Court and the European Court of Human Rights in the qualification of exploitation-related offenses, taking into account the context of armed conflict. Methods. The study employs comparative, systemic-structural, and formal-legal methods, which enable a juxtaposition of the provisions of the Criminal Code of Ukraine with international criminal law standards, as well as an analysis of the case law of the International Criminal Court and the European Court of Human Rights regarding the exploitation of individuals. Results. Based on indicative matrices, the study establishes that the current version of Article 438 of the Criminal Code of Ukraine does not adequately cover war crimes related to exploitation. The necessity of introducing a Concept for the Adaptation of the Criminal Code of Ukraine to the requirements of the Rome Statute and the Convention for the Protection of Human Rights and Fundamental Freedoms is substantiated. Conclusions. The proposed reform model strengthens criminal law guarantees for the protection of individuals, reduces the risks of Convention violations in national legal practice, and facilitates Ukraine’s integration into the European and international legal space.
