Item ЗАСТОСУВАННЯ НОРМ МІЖНАРОДНОГО МОРСЬКОГО ПРАВА В ЧОРНОМУ МОРІ В УМОВАХ ЗБРОЙНОГО КОНФЛІКТУ В УКРАЇНІ(2025) Панченко І.; Гавловська А.; Panchenko I.; Havlovska A.Мета. Стаття присвячена комплексному аналізу міжнародно-правового статусу Чорного моря та наслідків збройної агресії Російської Федерації проти України у морському вимірі. Особливу увагу приділено питанням свободи судноплавства, режиму напівзамкнутих морів, незаконної блокади пор- тів, мінної небезпеки, функціонуванню «зернових коридорів», а також ролі міжнародних організацій та судових інституцій у забезпеченні верховенства міжнародного морського права. Методи. У дослідженні використано загальнонаукові та спеціально-правові методи: системний і порівняльний аналіз, історико-правовий підхід, метод формально-юридичної інтерпретації, а також аналіз практики міжнародних судових органів (ITLOS, арбітражів за UNCLOS, Міжнародного суду ООН). Застосування комплексного підходу дозволило виявити взаємозв’язок між нормами універсального морського права та спеціальними договірними режимами, а також визначити прогалини у сучасному міжнародному регулюванні. Результати. Встановлено, що агресія Російської Федерації у Чорному морі супроводжується системними порушеннями міжнародного морського та гуманітарного права, включаючи незаконну блокаду портів, напади на цивільні судна, мінування акваторій та анексію морських просторів. Дослі- дження доводить, що навіть у кризових умовах міжнародне право залишається дієвим інструментом: приклади «зернової угоди», рішень ITLOS та санкцій ЄС підтверджують здатність міжнародних структур підтримувати функціонування правового порядку. Проаналізовано використання Україною міжнародних судових механізмів для захисту своїх морських прав та формування доказової бази май- бутньої відповідальності Російської Федерації. Висновки. Аналіз ситуації у Чорному морі свідчить про необхідність посилення ефективності міжнародного морського права у кризових умовах. Виклики, пов’язані з блокадою, мінною загрозою та обмеженням свободи судноплавства, потребують вироблення дієвих міжнародно-правових механіз- мів, здатних гарантувати належне виконання норм морського права. Досвід «зернових коридорів» довів можливість формування інноваційних правових механізмів у воєнний час. Роль міжнародних організацій і судових інституцій є вирішальною для збереження верховенства права, тоді як стратегія України підтверджує, що правові засоби залишаються дієвим шляхом захисту національних інтересів навіть у період збройної агресії. Objective. The article is dedicated to a comprehensive analysis of the international legal status of the Black Sea and the consequences of the Russian Federation's armed aggression against Ukraine in the maritime domain. Particular attention is paid to issues of freedom of navigation, the regime of semi-enclosed seas, ille- gal port blockades, mine threats, the functioning of the "grain corridors," as well as the role of international organizations and judicial institutions in ensuring the supremacy of international maritime law. Methods. The study employs general scientifi c and specialized legal methods, including systemic and com- parative analysis, a historical-legal approach, formal-legal interpretation, and analysis of international judicial practice (ITLOS, UNCLOS arbitration, International Court of Justice). The application of a comprehensive approach allowed for identifying the interrelation between the norms of universal maritime law and specifi c treaty regimes, as well as detecting gaps in contemporary international regulation. Results. It has been established that the Russian Federation's aggression in the Black Sea is accompanied by systematic violations of international maritime and humanitarian law, including illegal port blockades, attacks on civilian vessels, mining of maritime areas, and annexation of maritime spaces. The study demonstrates that international law remains an eff ective instrument even under crisis conditions: examples such as the "grain agreement," ITLOS decisions, and EU sanctions confi rm the capacity of international structures to maintain the rule of law. The use of international judicial mechanisms by Ukraine to protect its maritime rights and to build an evidentiary basis for future responsibility of the Russian Federation has been analyzed. Conclusions. The analysis of the situation in the Black Sea indicates the need to enhance the eff ectiveness of international maritime law in crisis conditions. Challenges related to blockades, mine threats, and restrictions on freedom of navigation require the development of eff ective international legal mechanisms capable of ensur- ing proper implementation of maritime law norms. The experience of the "grain corridors" has demonstrated the feasibility of creating innovative legal mechanisms in wartime. The role of international organizations and judicial institutions is crucial for preserving the rule of law, while Ukraine’s strategy confi rms that legal measures remain an eff ective means of protecting national interests even during armed aggression.Item ОБСТАВИНИ, ЩО ВИКЛЮЧАЮТЬ КРИМІНАЛЬНУ ВІДПОВІДАЛЬНІСТЬ ТА/АБО ЗВІЛЬНЮЮТЬ ВІД КРИМІНАЛЬНОЇ ВІДПОВІДАЛЬНОСТІ ЗА САМОВІЛЬНЕ ЗАЛИШЕННЯ ЧАСТИНИ АБО МІСЦЯ СЛУЖБИ(2025) Гавловська А.; Havlovska A.У цій статті поставлено за мету дослідження юридичних обставин, за яких військовослужбовець може бути звільнений від кримінальної відповідальності за СЗЧ та обставин, що виключають кримі- нальну відповідальність за даний вид військових кримінальних правопорушень. Для досягнення задекларованої мети та отримання належних результатів, використано таку сукупність методів: аналіз нормативно-правових актів, системний метод, формально-логічний метод, метод тлумачення норм права, функціональний метод. Результати та висновки такої діяльності. Визначено, що СЗЧ посягає на порядок несення військової служби та негативно впливає на боєздат- ність ЗСУ та інших військових формувань, а також на обороноздатність держави загалом. Розмеж- овано дві групи обставин, що впливають на юридичну долю військовослужбовця, який вчинив СЗЧ – обставини, що виключають кримінальну протиправність діяння та обставини, що звільняють від кримінальної відповідальності. Встановлено, що за наявності обставин, що виключають кримінальну протиправність діяння, діяння хоча формально й містить ознаки злочину, проте не визнається злочинним, оскільки втрачає свою суспільну небезпечність та/або протиправність. Здійснено поділ цих обставин на ті, що виклю- чають кримінальну ступінь суспільної небезпечності діяння, ті, що виключають кримінальну про- типравність діяння, та ті, що виключають одночасно суспільну небезпечність і протиправність. До недоліків правового регулювання застосування норм, що виключають кримінальну відповідальність за СЗЧ, віднесено непряме застосування загальних норм кримінального законодавства до специфічних військових правопорушень та складність визначення втрати діянням суспільної небезпечності або його «легалізації» в умовах воєнного стану. Визначено, що механізм звільнення за СЗЧ базується на положеннях законодавства, які передба- чають можливість звільнення військовослужбовця, який вперше вчинив таке діяння, за умови його добровільного з’явлення із зізнанням та повідомлення всіх обставин вчинення, а також відсутності умислу на повне ухилення від військової служби. Зазначено, що в практиці звільнення від кримінальної відповідальності в період воєнного стану можуть враховуватися такі обставини, як вчинення Серед недоліків правового регулювання звільнення від кримінальної відповідальності виділено розмитість критеріїв визначення умислу на повне ухилення від військової служби, що може призвести до суб’єк- тивізму в правозастосуванні. Запропоновано напрями вдосконалення правового регулювання, включаючи створення детальних роз’яснень для правозастосовних органів, забезпечення єдності судової практики, проведення тренін- гів для військових юристів, законодавче закріплення чітких критеріїв оцінки умислу та розвиток реа- білітаційних програм для військовослужбовців. This article aims to investigate legal circumstances in which a serviceman may be exempted from criminal liability for HRS and circumstances that exclude criminal liability for this type of military criminal offenses. To achieve the declared purpose and obtain the proper results, the following set of methods was used: analysis of normative legal acts, systemic method, formal-logical method, method of interpreting the rules of law, functional method. Results and conclusions of such activity. It is determined that the SCR is on the order of military service and has a negative impact on the combat capability of the Armed Forces and other military formations, as well as the defense capability of the state as a whole. There are two groups of circumstances that affect the legal fate of the serviceman who committed the HSC – circumstances that exclude criminal unlawfulness of the act and circumstances that are released from criminal liability. It is established that in the presence of circumstances that exclude criminal unlawfulness of the act, the act, although formally contains signs of crime, is not recognized as criminal because it loses its public danger and/or illegality. These circumstances were divided into those that exclude the criminal degree of public danger of act, those that exclude criminal illegality of the act, and those that exclude at the same time public danger and illegality.The disadvantages of legal regulation of the application of norms that exclude criminal liability for HRS include the indirect application of general rules of criminal legislation to specific military offenses and the complexity of determining the loss of public danger or its “legalization” in the conditions of martial law. It is determined that the mechanism of dismissal for the HCP is based on the provisions of the legislation, which provide for the possibility of dismissal of a serviceman who for the first time committed such an act, provided that he voluntarily appeared with confession and notification of all the circumstances of the commission, as well as the lack of intent for complete evasion of military service. It is stated that in the practice of criminal liability during the martial law, such circumstances may be taken into account as the deficiencies of legal regulation of exemption from criminal liability have the blurred criteria for determining intent for complete evasion of military service, which can lead to subjectivism in law enforcement. The directions of improvement of legal regulation, including the creation of detailed explanations for law enforcement agencies, ensuring the unity of jurisprudence, conducting trainings for military lawyers, legislative consolidation of clear criteria for assessing intent and development of rehabilitation programs for military personnel are proposed.
