ПИТАННЯ МІЖНАРОДНОЇ ПРАВОСУБ’ЄКТНОСТІ (КВАЗІДЕРЖАВ)

Формування світової спільноти є важливим процесом розвитку всього світового суспільства. Відповідно, виникнення, розвиток та зникнення держав активно впливає на розвиток інших держав та на міжнародні (міждержавні) відносини та на світову політику. Однак, діалектика міжнародних відносин вносить корективи у взаємодію між державами. Однією з таких особливостей слід вважати появу квазідержав, оскільки до другої половини ХХ століття не було юридичних приписів, які б дозволяли оголосити певне державоподібне утворення «поза законом» з точки зору загальноприйнятих міжнародно-правових норм. Однак, історія явища квазідержав показує, що через стадію «самопроголошена держава» пройшли майже не всі держави світу, починаючи з Нідерландів (які отримали визнання практично через 70 років після фактичної незалежності під час укладання Вестфальського миру у 1648 році), США, держав Латинської Америки тощо. The formation of the world community is an important process of development of the whole world society. Accordingly, the emergence, development and disappearance of states actively influence the development of other states and international (interstate) relations and world politics. However, the dialectic of international relations makes adjustments in the interaction between states. One of such features should be considered the emergence of quasi-states, because until the second half of the twentieth century there were no legal regulations that would allow to declare a state-like entity "outlawed" in terms of generally accepted international law. However, the history of the phenomenon of quasi-states shows that almost all countries of the world have passed through the stage of "self-proclaimed state", starting with the Netherlands (which was recognized almost 70 years after de facto independence during the Peace of Westphalia in 1648), USA, Latin America etc.
