    Інститут омбудсмана: правова природа та типологія

    Робота присвячена дослідженню правової природи та типології інституту омбудсмана. Проаналізовано становлення та сутність інституту омбудсмана як елемента механізму захисту прав людини, виділено різні підходи до визначення структури і особливостей механізму захисту прав людини в сучасних демократичних державах. Досліджено зарубіжний досвід функціонування моделей омбудсмана. З’ясовано правовий статус спеціалізованих омбудсманів. Проаналізовано конституційно-правовий статус Уповноваженого Верховної Ради України з прав людини. Надано характеристику створенню спеціалізованих омбудсманів як більш ефективної реалізації можливостей моделі омбудсмана в Україні. The paper is concentrated on the study of the legal nature and typology of the ombudsman institute. The formation and essence of the ombudsman institute as an element of the human rights protection mechanism are analyzed, different approaches to determining the structure and features of the human rights protection mechanism in modern democratic states are identified. The foreign experience of functioning of ombudsman models is studied. The legal status of specialized ombudsmen is clarified. The constitutional and legal status of the Ukrainian Parliament Commissioner for Human Rights is analyzed. The specification of creation of specialized ombudsmen as more effective realization of possibilities of the ombudsman model in Ukraine is given.
