Item ЗАСТОСУВАННЯ НОРМ МІЖНАРОДНОГО МОРСЬКОГО ПРАВА В ЧОРНОМУ МОРІ В УМОВАХ ЗБРОЙНОГО КОНФЛІКТУ В УКРАЇНІ(2025) Панченко І.; Гавловська А.; Panchenko I.; Havlovska A.Мета. Стаття присвячена комплексному аналізу міжнародно-правового статусу Чорного моря та наслідків збройної агресії Російської Федерації проти України у морському вимірі. Особливу увагу приділено питанням свободи судноплавства, режиму напівзамкнутих морів, незаконної блокади пор- тів, мінної небезпеки, функціонуванню «зернових коридорів», а також ролі міжнародних організацій та судових інституцій у забезпеченні верховенства міжнародного морського права. Методи. У дослідженні використано загальнонаукові та спеціально-правові методи: системний і порівняльний аналіз, історико-правовий підхід, метод формально-юридичної інтерпретації, а також аналіз практики міжнародних судових органів (ITLOS, арбітражів за UNCLOS, Міжнародного суду ООН). Застосування комплексного підходу дозволило виявити взаємозв’язок між нормами універсального морського права та спеціальними договірними режимами, а також визначити прогалини у сучасному міжнародному регулюванні. Результати. Встановлено, що агресія Російської Федерації у Чорному морі супроводжується системними порушеннями міжнародного морського та гуманітарного права, включаючи незаконну блокаду портів, напади на цивільні судна, мінування акваторій та анексію морських просторів. Дослі- дження доводить, що навіть у кризових умовах міжнародне право залишається дієвим інструментом: приклади «зернової угоди», рішень ITLOS та санкцій ЄС підтверджують здатність міжнародних структур підтримувати функціонування правового порядку. Проаналізовано використання Україною міжнародних судових механізмів для захисту своїх морських прав та формування доказової бази май- бутньої відповідальності Російської Федерації. Висновки. Аналіз ситуації у Чорному морі свідчить про необхідність посилення ефективності міжнародного морського права у кризових умовах. Виклики, пов’язані з блокадою, мінною загрозою та обмеженням свободи судноплавства, потребують вироблення дієвих міжнародно-правових механіз- мів, здатних гарантувати належне виконання норм морського права. Досвід «зернових коридорів» довів можливість формування інноваційних правових механізмів у воєнний час. Роль міжнародних організацій і судових інституцій є вирішальною для збереження верховенства права, тоді як стратегія України підтверджує, що правові засоби залишаються дієвим шляхом захисту національних інтересів навіть у період збройної агресії. Objective. The article is dedicated to a comprehensive analysis of the international legal status of the Black Sea and the consequences of the Russian Federation's armed aggression against Ukraine in the maritime domain. Particular attention is paid to issues of freedom of navigation, the regime of semi-enclosed seas, ille- gal port blockades, mine threats, the functioning of the "grain corridors," as well as the role of international organizations and judicial institutions in ensuring the supremacy of international maritime law. Methods. The study employs general scientifi c and specialized legal methods, including systemic and com- parative analysis, a historical-legal approach, formal-legal interpretation, and analysis of international judicial practice (ITLOS, UNCLOS arbitration, International Court of Justice). The application of a comprehensive approach allowed for identifying the interrelation between the norms of universal maritime law and specifi c treaty regimes, as well as detecting gaps in contemporary international regulation. Results. It has been established that the Russian Federation's aggression in the Black Sea is accompanied by systematic violations of international maritime and humanitarian law, including illegal port blockades, attacks on civilian vessels, mining of maritime areas, and annexation of maritime spaces. The study demonstrates that international law remains an eff ective instrument even under crisis conditions: examples such as the "grain agreement," ITLOS decisions, and EU sanctions confi rm the capacity of international structures to maintain the rule of law. The use of international judicial mechanisms by Ukraine to protect its maritime rights and to build an evidentiary basis for future responsibility of the Russian Federation has been analyzed. Conclusions. The analysis of the situation in the Black Sea indicates the need to enhance the eff ectiveness of international maritime law in crisis conditions. Challenges related to blockades, mine threats, and restrictions on freedom of navigation require the development of eff ective international legal mechanisms capable of ensur- ing proper implementation of maritime law norms. The experience of the "grain corridors" has demonstrated the feasibility of creating innovative legal mechanisms in wartime. The role of international organizations and judicial institutions is crucial for preserving the rule of law, while Ukraine’s strategy confi rms that legal measures remain an eff ective means of protecting national interests even during armed aggression.
