Abstract

The presented dissertation is devoted to a comprehensive theoretical and applied study of the institution of the interpreter as an independent participant in criminal proceedings, its historical and legal origins, the current regulatory framework governing its activity, procedural functions, scope of professional competence, ethical standards, and practical aspects of ensuring the quality of interpretation in criminal justice. The study provides a systematic analysis of the interpreter’s role in ensuring the principle of the language of criminal proceedings, the realization of the individual’s right to a fair trial and access to justice and identifies directions for improving the legal regulation of the interpreter’s participation in criminal proceedings with due regard to international standards and foreign experience. The research is structured according to a consistent logical progression: from the study of the general history of translation activity and the theoretical foundations of translation studies as an interdisciplinary field of humanitarian knowledge to the analysis of specific legal constructions regulating the involvement of interpreters in criminal proceedings in leading countries of the world and in Ukraine, as well as the development of practical recommendations aimed at improving the legal regulation of the relevant issues, including through amendments to existing legislation. The methodological basis of the dissertation consists of a complex of general scientific and special legal research methods, as well as empirical methods (sociological surveys and statistical analysis), the application of which made it possible to combine doctrinal achievements with practical observations and comparative analytical approaches. The dissertation presents the first comparative theoretical and legal study in Ukraine devoted to the status of the interpreter as a participant in criminal proceedings in Ukraine and foreign jurisdictions. The first chapter provides a retrospective analysis of the historical evolution of translation activity as a means of communication, a profession, and a socio-legal institution. It illustrates its development from antiquity to the present and highlights the peculiarities of the formation of criminal procedural interpretation on the territory of Ukraine. It has been established that translation practice for a long time performed the function of ensuring communication between representatives of different linguistic communities and already at the early stages of the development of legal systems played an important role in ensuring the authenticity of legal acts, judicial decisions, and public testimonies. The study traces the gradual institutionalization of the interpreter’s role and the transformation of requirements for professional competence under the influence of socio-cultural and legal transformations of society, as well as the formation of translation studies as a separate philological and linguistic discipline. Particular attention is paid to the development of legal regulation of the interpreter’s participation in criminal proceedings on the Ukrainian territories. It has been established that the first systemic prerequisites for the normative consolidation of the interpreter’s participation were formed in the Judicial Statutes of 1864, which introduced the possibility of involving interpreters in judicial proceedings and regulated the procedure for their oath and challenge. At the same time, during that period the interpreter was perceived mainly as a technical auxiliary participant. The further evolution of this institution was reflected in the criminal procedural legislation of the 1920s, which provided for the obligation to involve an interpreter where participants did not know the language of the proceedings and introduced certain procedural rights and guarantees of the interpreter’s activity. However, the subsequent legislative process of the Soviet era did not substantially modernize the interpreter’s legal status. It is concluded that the historical development of the interpreter institution demonstrates a gradual transition from its perception as a technical intermediary to the recognition of its importance for safeguarding procedural rights and ensuring the legality of criminal procedural activities. The second chapter is devoted to a detailed examination of the procedural status of the interpreter within modern Ukrainian criminal proceedings. The analysis of current criminal procedural legislation revealed a number of significant regulatory gaps concerning the involvement and participation of interpreters in criminal proceedings. In particular, the law does not provide a definition of the interpreter as a participant in criminal procedural legal relations, which negatively affects the implementation of the principle of legal certainty. Although the interpreter is recognized as another participant in criminal proceedings and endowed with a set of procedural rights and obligations, the legislation does not regulate the requirements for professional qualifications and competence, procedures for their verification, or mechanisms for monitoring the quality of interpretation during proceedings. In order to minimize the risks arising from these deficiencies and to improve the legal regulation of the relevant issues, the author proposes practical recommendations and specific amendments to the relevant legislation. Among other proposals, the dissertation formulates an author’s definition of the interpreter as a procedurally disinterested person who possesses appropriate qualifications, has a sufficient command of the state language and another language or other means of communication, and is involved by the parties to criminal proceedings, the investigating judge, or the court in the cases and according to the procedure established by law for the purpose of interpreting (including sign-language interpretation) explanations, testimonies, or documents in criminal proceedings. Considerable attention is also paid to the legal consequences of interpretation that does not meet the criteria of accuracy, adequacy, and neutrality, including the risks of distortion of evidence, violation of the right to defence, and damage to procedural fairness. The study identifies significant deficiencies in the legal framework, including the absence of a legislative definition of the interpreter’s procedural role, the lack of mechanisms for certification and centralized registration of interpreters involved in criminal proceedings, the absence of standardized rules for recording interpretation, the imperfection of procedures for challenging the quality of interpretation, and the insufficient regulation of remuneration and reimbursement of interpreters’ expenses. The third chapter contains a comparative analysis of international standards and national models for the organization of court interpretation (including the practices of Germany, Poland, Austria, the Netherlands, France, and the United States), as well as relevant case law of the European Court of Human Rights. It has been established that European jurisdictions apply systematic approaches to the training, certification, and remuneration of court interpreters, introduce national registers, and implement mechanisms for monitoring the quality of interpretation. Such approaches significantly increase trust in interpretation as a procedural instrument and minimize the risks of violations of the rights of participants in criminal proceedings. On the basis of the comparative analysis, the necessity of adapting best international practices of regulating criminal procedural interpretation to Ukrainian conditions has been substantiated, taking into account the specific features of the national legal framework and judicial practice. As a result of the comparative study, a number of concrete proposals and recommendations have been formulated, including: the legislative definition of the interpreter as a participant in criminal proceedings with the establishment of minimum qualification requirements; regulation at the by-law level of professional ethics and standards of conduct for interpreters involved in criminal proceedings; the creation of a unified state register of such interpreters indicating differentiated language competencies and specializations; the introduction of a certification and attestation system with practical examinations and periodic professional training; the development of an interpreter’s code of ethics establishing principles of neutrality, confidentiality, and safeguards against conflicts of interest; the establishment of procedures for recording interpretation and technical requirements for such recording; the definition of a transparent mechanism for challenging the quality of interpretation and replacing an interpreter during proceedings; the regulation of remuneration and reimbursement procedures using unified tariffs and methods for assessing the complexity of interpreting tasks based on real cases; and the introduction of training modules for judges, investigators, prosecutors, and lawyers concerning interaction with interpreters and the assessment of interpretation quality. The scientific novelty of the dissertation lies in the formation of a comprehensive theoretical and legal concept of the interpreter as an independent participant in criminal proceedings, integrating historical-legal analysis, doctrinal approaches, empirical observations, the study of the influence of modern technologies on interpretation processes, and a comparative review of international experience in the legal regulation of interpreters’ participation in criminal proceedings. The practical significance of the dissertation results lies in the possibility of their direct application in the development of amendments to the criminal procedural legislation of Ukraine, sectoral by-laws regulating the national translation and interpretation sector, including the creation of state registers and certification systems for interpreters, in methodological recommendations for courts, investigators, prosecutors, and lawyers, as well as in the development of educational programs and professional training courses. The proposed provisions will contribute to improving the quality of interpretation in criminal proceedings, protecting the rights of persons who do not possess sufficient command of the state language, and strengthening public trust in the justice system as a whole.
