Item ЦИВІЛЬНО-ПРАВОВІ ЗАСАДИ ЗАХИСТУ ЧЕСТІ, ГІДНОСТІ ТА ДІЛОВОЇ РЕПУТАЦІЇ У КОНТЕКСТІ БАЛАНСУ МІЖ НЕДОТОРКАННІСТЮ ПРИВАТНОГО ЖИТТЯ І СВОБОДОЮ ВИРАЖЕННЯ ПОГЛЯДІВ(2026) Козлова В. В.Кваліфікаційна робота присвячена комплексному аналізу цивільно-правових механізмів охорони честі, гідності та ділової репутації в умовах цифровізації та загострення конфлікту між правом на повагу до приватного життя і свободою вираження поглядів. У дослідженні розкрито правову природу цих особистих немайнових благ та проаналізовано вплив інформаційних технологій (зокрема соціальних мереж) на специфіку їх захисту. Значну увагу приділено пошуку раціонального балансу між конкуруючими правами на основі європейських стандартів (зокрема, застосування «тесту на пропорційність» ЄСПЛ). Досліджено особливості судового захисту, складнощі розмежування оціночних суджень і фактичних тверджень та проблему деанонімізації правопорушників в Інтернеті. Сформульовано пропозиції щодо вдосконалення вітчизняного цивільного законодавства: законодавче закріплення дефініцій «дифамація» та «образа», модернізацію механізмів відшкодування моральної шкоди, завданої через кіберпростір, а також впровадження обов'язкової деідентифікації учасників судових справ для захисту права на забуття та запобігання «ефекту Стрейзанд». The qualification work is devoted to a comprehensive analysis of civil law mechanisms for protecting honor, dignity, and business reputation in the context of digitalization and the aggravation of the conflict between the right to respect for private life and freedom of expression. The study reveals the legal nature of these personal non-property rights and analyzes the impact of information technologies (in particular, social networks) on the specifics of their protection. Significant attention is paid to finding a rational balance between competing rights based on European standards (in particular, the application of the ECtHR's "proportionality test"). The specifics of judicial protection, the difficulties of distinguishing between value judgments and factual statements, and the problem of deanonymization of offenders on the Internet are investigated. Proposals for improving domestic civil legislation are formulated: legislative consolidation of the definitions of "defamation" and "insult", modernization of mechanisms for compensation of moral damage caused through cyberspace, as well as the introduction of mandatory de-identification of participants in court cases to protect the right to be forgotten and prevent the "Streisand effect".
