Item ЗАЛУЧЕННЯ ПЕРЕКЛАДАЧА В КРИМІНАЛЬНОМУ ПРОЦЕСІ УКРАЇНИ(2026) Шафоркіна Ю. Г.Кваліфікаційна робота присвячена комплексному аналізу теоретико-правових, організаційних та практичних засад залучення перекладача у кримінальному судочинстві України. У дослідженні ґрунтовно розкрито процесуальний статус, права, обов'язки та механізм залучення перекладача, а також підстави для його відводу. Значну увагу приділено гарантіям якості перекладу, межам юридичної (зокрема кримінальної) відповідальності спеціаліста та процесуальним наслідкам порушення мовних прав учасників провадження крізь призму прецедентної практики ЄСПЛ. Сформульовано науково обґрунтовані пропозиції щодо вдосконалення профільного законодавства, зокрема щодо інституціоналізації професії присяжного судового перекладача зі створенням Єдиного реєстру при Мін'юсті та запровадження обов'язкової відеофіксації слідчих дій за його участю. The qualification work is devoted to a comprehensive analysis of the theoretical, legal, organizational and practical grounds for the involvement of an interpreter in the criminal proceedings of Ukraine. The study thoroughly reveals the procedural status, rights, duties and mechanism of involving an interpreter, as well as the grounds for their recusal. Significant attention is paid to translation quality guarantees, the limits of the specialist's legal (in particular, criminal) liability, and the procedural consequences of violating the language rights of participants in the proceedings through the prism of the ECHR case law. Scientifically substantiated proposals for improving relevant legislation have been formulated, in particular regarding the institutionalization of the profession of a sworn court interpreter with the creation of a Unified Register at the Ministry of Justice and the introduction of mandatory video recording of investigative actions with their participation.
