В роботі досліджується становлення та розвиток законодавчого регулювання відносин у сфері захисту прав біженців та мігрантів у країнах ЄС; проаналізовано нормативно-правове регулювання відносин у цій сфері; розглянуто поняття біженця та мігранта як суб'єктів правовідносин; досліджено поняття та зміст правового статусу суб'єктів правовідносин у сфері захисту прав біженців та мігрантів; розкрито зміст правовідносин у цій сфері; досліджено проблемні питання правового регулювання відносин у сфері захисту прав біженців та мігрантів у контексті різних національних правових систем країн ЄС. Dedicated to the comprehensive study of problems of the theory and practice of the legal regime of refugees and migrants in Europe. The paper examines the formation and development of legislative regulation of relations in the sphere of protection of the rights of refugees and migrants in the EU countries; the regulatory and legal regulation of relations in this area is analyzed; the concepts of refugee and migrant as subjects of legal relations are considered; the concept and content of the legal status of the subjects of legal relations in the field of protection of the rights of refugees and migrants were investigated; the content of legal relations in this area is disclosed; problematic issues of legal regulation of relations in the field of protection of the rights of refugees and migrants in the context of various national legal systems of the EU countries are investigated.Item ІНСТИТУТ В ОРГАНІЗАЦІЙНІЙ СТРУКТУРІ ПРАВА ЄС(2024) Болсун, А. М.Кваліфікаційна робота присвячена дослідженню інститутів у організаційній структурі права ЄС. В роботі розкрито природу правової системи права Європейського Союзу: загальна характеристика, принципи права Європейського Союзу, охарактеризовано правосуб’єктність Європейського Союзу, визначено поняття наднаціональності у праві ЄС Рада Міністрів, склад та повноваження. Також, визначено правовий статус Європейської комісії, Європейського Парламенту, Суду Співтовариств, Європейської Ради, Європейського Центрального Банку. The qualification work is devoted to the study of institutions in the organizational structure of EU law. The work reveals the nature of the legal system of the law of the European Union: general characteristics, principles of the law of the European Union, the legal personality of the European Union is characterized, the concept of supranationality in EU law, the Council of Ministers, its composition and powers are defined. Also, the legal status of the European Commission, the European Parliament, the Court of Communities, the European Council, and the European Central Bank is determined.
