Item КРИМІНАЛЬНО-ПРАВОВА ОХОРОНА ПРАВА НА ЖИТТЯ В УКРАЇНІ(2021) Логацький, С. А.Кваліфікаційна робота присвячена дослідженню кримінально-правової охорони права на життя в Україні. В роботі проаналізовано загальнотеоретичні передумови кримінально-правової охорони права на життя; визначено поняття та зміст права на життя; розкрито особливості загально-правового механізму захисту права на життя; проаналізовано елементи кримінально-правового механізму охорони права на життя; охарактеризовано теоретично-правові засади кримінально-правового захисту права людини на життя; досліджено межі кримінально-правової охорони права людини на життя. Qualification work is devoted to the study of criminal law protection of the right to life in Ukraine. The paper analyzes the general theoretical prerequisites for criminal law protection of the right to life; the concept and content of the right to life are defined; the peculiarities of the general legal mechanism of protection of the right to life are revealed; the elements of the criminal-legal mechanism of protection of the right to life are analyzed; the theoretical and legal bases of criminal-legal protection of the human right to life are characterized; the limits of criminal law protection of the human right to life are investigated.Item ПРАВО НА САМОЗАХИСТ ЖИТТЯ І ЗДОРОВ’Я ВІД ПРОТИПРАВНИХ ПОСЯГАНЬ(2021) Біжик, А. В.Кваліфікаційна робота присвячена дослідженню права на самозахист життя та здоров’я особи та обґрунтування теоретично-правових питань та практичних проблем, пов’язаних з реалізацією даного права. В роботі досліджено історико-правові передумови становлення та розвитку права на самозахист; здійснено ретроспективний аналіз формування права на самозахист; визначено особливості становлення та розвитку права на самозахист в Україні; проаналізовано поняття, ознаки та зміст право на самозахист; визначено структуру та місце самозахисту в системі законодавства України; проаналізовано проблеми та перспективи нормативно-правового закріплення право на застосування зброї в межах самозахисту життя та здоров’я. The qualification work is devoted to the study of the right to self-defense of life and health of the person and substantiation of theoretical and legal issues and practical problems related to the implementation of this right. The historical and legal preconditions of formation and development of the right to self-defense are investigated in the work; a retrospective analysis of the formation of the right to self-defense was carried out; the peculiarities of formation and development of the right to self-defense in Ukraine are determined; the concept, signs and content of the right to self-defense are analyzed; the structure and place of self-defense in the system of legislation of Ukraine are determined; analyzed the problems and prospects of legal consolidation of the right to use weapons in self-defense of life and health.
