Item КOРПOРAТИВНI ПРАВА ДЕРЖАВИ ЗА ЗАКОНОДАВСТВОМ УКРАЇНИ(2020) Бєлеста, Я. В.Присвячена комплексному дослідженню основних положень концепції поняття та реалізації корпоративних прав держави, визначення науково-теоретичних підходів удосконалення діючого законодавства в сфері управління державними корпоративними правами. В роботі охарактеризовано правову природу державних корпоративних прав та їх елементи, систематизовано підстави виникнення та припинення державних корпоративних прав, проаналізовано шляхи механізму правового захисту інтересів держави у процесі реалізації належних їй корпоративних прав без обмеження законних інтересів інших власників (учасників). Також в роботі запропоновано шляхи оптимізації способів та форм реалізації державою корпоративних прав і встановити їх особливості, виявлено особливості механізмів управління державними корпоративними правами, визначено мету, напрями, завдання та основні проблеми управління державними корпоративними правами. Dedicated to a comprehensive study of the main provisions of the concept and implementation of corporate rights of the state, the definition of scientific and theoretical approaches to improving existing legislation in the field of management of state corporate rights. The paper describes the legal nature of state corporate rights and their elements, systematizes the grounds for the emergence and termination of state corporate rights, analyzes the ways of legal protection of state interests in the implementation of corporate rights without restricting the legitimate interests of other owners (participants). Also in the work the ways of optimization of ways and forms of realization of the corporate rights by the state are offered and to establish their features, features of mechanisms of management of the state corporate rights are revealed, the purpose, directions, tasks and basic problems of management of the state corporate rights are defined.Item ПРАВОВИЙ МЕХАНІЗМ ЗАХИСТУ БАНКІВСЬКОЇ ТАЄМНИЦІ(2020) Швецов, М. О.Присвячена комплексному дослідженню правового механізму захисту банківської таємниці, визначенню кола теоретичних та практичних проблем у цій сфері. В роботі розкрито поняття та зміст банківської таємниці, визначено ознаки банківської таємниці та відокремлено її від інших видів інформації, проаналізовано правовий режим захисту банківської таємниці, визначено форми правомірного розкриття банківської таємниці. Також в роботі визначено теоретичні та практичні проблеми у сфері правового регулювання захисту банківської таємниці проаналізовано особливості правового захисту банківської таємниці в зарубіжних країнах, обґрунтовано пропозиції з удосконалення правового регулювання відносин щодо банківської таємниці в Україні на основі законодавства ЄС. Devoted to the complex research of the legal mechanism of protection of Bank secrecy, determine the range of theoretical and practical problems in this field. The disclosed concept and content of banking secrecy defined the characteristics of Bank secrecy and its isolation from other kinds of information, analyzed the legal regime for the protection of Bank secrecy, specified forms of lawful disclosure of banking secrecy. Also the paper identifies theoretical and practical problems in the sphere of legal regulation of protection of banking secrecy analyzes the features of legal protection of Bank secrecy in foreign countries, justified proposals for improvement of legal regulation of Bank secret in Ukraine based on EU legislation.
