Item СУЧАСНІ ВІЗІЇ ІСТОРІЇ МАГДЕБУРЗЬКОГО ПРАВА В УКРАЇНІ(2020) Андрієвський, С. С.Роль магдебурзького права в поступі українських міст та становленні національного права на українських землях є однією з найбільш дискусійних проблем в історії України. Мета роботи: аналіз специфіки сучасної візії історії магдебурзького права в Україні. Проаналізовано сучасні погляди українських істориків та правознавців на дискусійне питання щодо причин запровадження магдебурзького права в Україні. З’ясовано, що реконструювати об’єктивні причини запровадження магдебурзького права в Україні доцільно в межах цивілізаційного дискурсу. Порівняльно- правовий аналіз дозволяє стверджувати, що магдебурзьке право у значній мірі відповідало українським соціально-правовим реаліям. Застосування принципів теорії модернізації свідчить, що етапи модернізації кореспондуються з хвилями розповсюдження магдебурзького права. Водночас, головний евристичний потенціалз ’ясування причин запровадження магдебурзького права полягає у входженні України в європейську цивілізацію, передусім в часи Речі Посполитої. The role of Magdeburg law in the progress of Ukrainian cities and the formation of national law in the Ukrainian lands is one of the most controversial issues in the history of Ukraine Purpose: analysis of the specifics of the modern vision of the history of Magdeburg law in Ukraine. The modern views of Ukrainian historians and jurists on the debatable issue of the reasons for the introduction of Magdeburg law in Ukraine are analyzed. It is found that it is expedient to reconstruct the objective reasons for the introduction of Magdeburg law in Ukraine within the framework of civilizational discourse. Comparative legalanalysissuggeststhat Magdebur glaw largelycorrespondedtothe Ukrainian socialandlegalrealities. The application of the principles of the theoryof modernization showsth at the stages of modernization correspond to the waves of the spread of Magdeburg law. Atthesametime, the mainheuristicpotential of findingoutthereasonsfor the introduction of Magdeburglawlies in Ukraine’sentry in to European civilization, especially during the Commonwealth.
