ВІДЕОФІКСАЦІЯ СЛІДЧИХ ДІЙ ЯК ГАРАНТІЯ ДОТРИМАННЯ І ЗАХИСТУ ПРАВ УЧАСНИКІВ КРИМІНАЛЬНОГО ПРОВАДЖЕННЯ

Abstract

Стаття присвячена сучасному стану правового регулювання використання відеофікації при проведенні слідчих дій. На основі дослідження проблем теорії, нормативно-правового регулювання та практики, в статті обґрунтовується необхідність нормативно-правового закріплення обов’язкової відеофіксації слідчих дій як гарантії дотримання прав та законних інтересів учасників кримінального провадження. The article examines the necessity of introducing obligatory video recording of investigative actions as a guarantee of observance and protection of the rights of the participants in the criminal proceedings. The author looks at the main problems of theory and practice, which confirm the need for such innovations. In particular, the necessity of attracting specialists during the video recording of investigative actions as a person possessing special knowledge and skills is confirmed. the use of special knowledge expands the volume and increases the quality of the received evidence, allows more fully and comprehensively to evaluate the connection of objects and phenomena that are relevant for criminal proceedings. The author also stresses the fragmentation of legal norms regarding the possibilities of video recording of investigating actions, which, as a consequence, has a negative impact on their implementation. Particular attention is paid in the article to the problems of practice, namely, the possibility of using the received video files during the conduct of the tacit investigative actions at the subsequent stages of the criminal proceedings as an expert material.
