Abstract
У статті поставлено за мету дослідження правових засад реалізації принципів кримінального провадження в умовах воєнного стану.
Для досягнення поставленої мети та отримання об'єктивних результатів було застосовано комп- лекс загальнонаукових та спеціально-правових методів, а саме: діалектичний, системно-структур- ний, формально-юридичний та метод аналізу і синтезу. Результати та висновки такої діяльності.
У статті виконано комплексне дослідження сутності принципів кримінального процесу, визначено їх роль як базових орієнтирів у функціонуванні системи правосуддя. Здійснено узагальнення наукових підходів до розуміння принципів кримінального провадження, розкрито їх регулятивну, гарантійну та системоутворюючу функції. Визначено, що саме в період дії воєнного стану принципи набувають особливого значення як засіб забезпечення балансу між публічними інтересами держави та охороною прав і свобод людини.
Проаналізовано особливості правового регулювання кримінального процесу у воєнний час, визна- чено напрями трансформації процедурних норм та механізмів реалізації основоположних принципів.
Здійснено характеристику проблем, пов’язаних з обмеженням доступу до правосуддя, ускладненням збирання доказів, визначенням територіальної підсудності та організацією судових засідань в екс- тремальних умовах. Виконано аналіз особливостей тлумачення й застосування окремих процесуальних норм, здійснено оцінку їх впливу на гарантії прав людини. Узагальнено, що функціонування кримінального провадження в умовах воєнного стану потребує не лише нормативного врегулювання, а й постійного доктринального осмислення, аби уникнути девальвації основоположних принципів правосуддя. Дослі- дження підтверджує необхідність пошуку оптимального балансу між захистом державних інтересів і забезпеченням фундаментальних прав людини. The article aims to study the legal principles of the principles of criminal proceedings in the conditions of martial law.
To achieve this goal and objective results, a complex of general scientifi c and special-legal methods was applied, namely: dialectical, system-structural, formal legal and method of analysis and synthesis. Results and conclusions of such activity. The article performs a comprehensive study of the essence of the principles of criminal process, defi nes their role as basic guidelines in the functioning of the justice system. Summari- zing scientifi c approaches to understanding the principles of criminal proceedings, their regulatory, warranty and system – forming functions are revealed. It is determined that it is during the period of martial law that the principles are of particular importance as a means of ensuring the balance between the public interests of the state and the protection of human rights and freedoms.
The peculiarities of legal regulation of criminal process in wartime are analyzed, the directions of trans- formation of procedural norms and mechanisms of implementation of fundamental principles are determined.
The problems related to restriction of access to justice, complication of evidence, determination of territorial jurisdiction and organization of court sessions in extreme conditions were characterized. Analysis of the pecu- liarities of interpretation and application of individual procedural norms was carried out, their infl uence on the guarantees of human rights was evaluated.It is summarized that the functioning of criminal proceedings in martial law requires not only regulatory settlement, but also constant doctrinal understanding in order to avoid the devaluation of the fundamental principles of justice. The study confi rms the need to fi nd the optimal balance between protecting state interests and ensuring fundamental human rights.
