Abstract
Кваліфікаційна робота на тему «Міжнародно-правовий механізм запобігання та протидії залученню дітей до участі у збройних конфліктах» присвячена дослідженню становлення міжнародних стандартів, нормативно-правової бази та механізмів їхньої реалізації у сфері захисту дітей в умовах збройних конфліктів.
У першому розділі роботи аналізується еволюція міжнародного підходу до захисту прав дитини у воєнний час, починаючи з перших спроб міжнародної спільноти врегулювати цю проблему і до формування сучасних всеосяжних міжнародно-правових документів. Окрему увагу приділено нормативно-правовій базі, що регулює питання запобігання залученню дітей до збройних конфліктів, включаючи ключові міжнародні конвенції, протоколи та резолюції.
Другий розділ спрямований на вивчення механізмів реалізації міжнародно-правових норм у сфері протидії участі дітей у збройних конфліктах. Тут досліджуються інституційні механізми, зокрема роль міжнародних організацій та неурядових об'єднань, а також аналізуються проблеми та перспективи імплементації міжнародних стандартів захисту дітей у національні правові системи держав.
Робота містить науково обґрунтовані висновки та пропозиції щодо оптимізації існуючого міжнародно-правового механізму захисту дітей у збройних конфліктах, що сприятиме підвищенню ефективності міжнародного співробітництва у цій надзвичайно важливій сфері.
Qualification work on "International legal mechanism of prevention and counteraction to involvement in armed conflicts" is devoted to the study of the formation of international standards, regulatory framework and mechanisms for their implementation in the field of children's protection in armed conflicts.
The first section of the work analyzes the evolution of an international approach to the protection of the rights of the child in wartime, starting with the first attempts of the international community to regulate this problem and to the formation of modern comprehensive international legal documents. Particular attention is paid to the regulatory framework governing the issue of prevention of involvement of children in armed conflict, including key international conventions, protocols and resolutions.
The second section is aimed at studying the mechanisms of implementation of international legal norms in the field of counteracting children's participation in armed conflicts. Institutional mechanisms, including the role of international organizations and non -governmental associations, are investigated here, as well as analyzing the problems and prospects of implementation of international standards for the protection of children into national legal systems of states.
The work contains scientifically sound conclusions and proposals for optimizing the existing international legal mechanism for the protection of children in armed conflict, which will increase the effectiveness of international cooperation in this extremely important area.
