dc.description.abstractКваліфікаційна робота на тему «Кримінально-правова характеристика стадій правопорушення» присвячена комплексному дослідженню теоретичних та прикладних аспектів реалізації злочинного наміру. У роботі розкрито зміст та значення стадій вчинення правопорушення, проведено розмежування між готуванням, замахом та закінченим діянням. Автор аналізує критерії, за якими визначається момент припинення злочинної діяльності, та досліджує вплив конструкції складу правопорушення на визначення його стадії. Особлива увагу у дослідженні приділено актуальним питанням кваліфікації правопорушень в умовах воєнного стану, що виник внаслідок збройної агресії, яку здійснює росія. У роботі аргументовано необхідність чіткого розмежування незакінченого правопорушення та добровільної відмови від його вчинення. На основі аналізу судової практики та наукових доктрин розроблено пропозиції щодо вдосконалення чинного кримінального законодавства України в частині регламентації відповідальності за стадії правопорушення. The qualification work on the topic "Criminal-legal characteristics of the stages of the offense" is devoted to a comprehensive study of theoretical and applied aspects of the implementation of criminal intent. The content and significance of the stages of the commission of the offense are disclosed in the work, a distinction is made between preparation, attempt and the completed act. The author analyzes the criteria by which the moment of cessation of criminal activity is determined and examines the influence of the structure of the composition of the offense on determining its stage. Special attention in the study is paid to the topical issues of the qualification of offenses in the conditions of martial law, which arose as a result of the armed aggression carried out by Russia. The work argues the need for a clear distinction between an unfinished offense and a voluntary refusal to commit it. On the basis of the analysis of judicial practice and scientific doctrines, proposals have been developed to improve the current criminal legislation of Ukraine in terms of regulation of responsibility for the stages of the offense.
