Item РОЛЬ ПЕРЕКЛАДАЧА У ЗАБЕЗПЕЧЕННІ ПРАВА НА СПРАВЕДЛИВИЙ СУД: АНАЛІЗ ПРАКТИКИ ЄВРОПЕЙСЬКОГО СУДУ З ПРАВ ЛЮДИНИ(2025) Бриков В. М.; Brykov V.Метою статті є дослідження ролі перекладача у кримінальному провадженні як гаранта реалізації права нас справедливий суд, зокрема права особи, яка не володіє мовою судочинства, на використання допомоги перекладача у контексті застосування практики Європейського суду з прав людини. Методи. Методологічну основу дослідження становлять загальнонаукові та спеціально правові методи, зокрема діалектичний, формально-юридичний (догматичний), герменевтичний, метод систем- ного аналізу, метод теоретичного узагальнення. Результати. На основі здійсненого аналізу практики ЄСПЛ, вивчення доктринальних джерел та сучасних прецедентів правозастосування органів судової влади: • Надано детальну характеристику перекладача як гаранта права на справедливий суд; • Продемонстровано різні підходи ЄСПЛ до визначення ролі, функцій, повноважень та компетенцій перекладача у кримінальному провадженні; • Сформовано перелік вимог до перекладача, які мають бути забезпечені для належного дотримання права на справедливий суд. • Наведено перелік підстав за яких право на справедливий суд вважається порушеним через нена- лежне залучення перекладача. • Виокремлено низку проблемних питань та ризиків, що можуть загрожувати реалізації ролі перекладача як гаранта права на справедливий суд та запропоновано варіанти вирішення даних проблем. Висновки. На основі аналізу доктринальних підходів та практики ЄСПЛ встановлено, що належне мовне посередництво є ключовою умовою реалізації права на справедливий суд. Перекладач у судовому процесі виконує не лише технічну, а й правозахисну функцію, забезпечуючи реальну участь особи, яка не володіє мовою судочинства, у процесі. Судова практика підтверджує, що формальне залу- чення перекладача не гарантує справедливості – визначальними є якість, точність і ефективність перекладу. Інститут судового перекладу інтегрує правові та комунікативні виміри процесуальної справедливості, утверджуючи принцип рівності сторін і доступу до правосуддя як прояв «людяного правосуддя». The purpose of this article is to examine the role of interpreters in criminal proceedings as guarantors of the right to a fair trial, in particular the right of persons who do not speak the language of the proceedings to use the services of an interpreter in the context of the practice of the European Court of Human Rights. Methods. The methodological fundament of the research is based on general scientifi c and special legal methods, in particular, dialectical, systemic analysis, and theoretical generalization. Results. Based on an analysis of ECHR practice, a study of doctrinal sources, and contemporary precedents in the application of law by judicial authorities: • A detailed description of the interpreter as a guarantor of the right to a fair trial is provided; • Various approaches of the ECHR to determining the role, functions, powers, and competences of inter- preters in criminal proceedings are demonstrated; • A list of requirements for interpreters that must be met to ensure proper observance of the right to a fair trial is compiled; • A list of grounds on which the right to a fair trial is considered to have been violated due to the improper involvement of an interpreter is provided; • A number of problematic issues and risks that may threaten the implementation of the role of interpreters as guarantors of the right to a fair trial are identifi ed, and options for solving these problems are proposed. Conclusions. On the basis of an analysis of doctrinal approaches and the practice of the ECHR, it has been established that proper language mediation is a key condition for the realization of the right to a fair trial. Interpreters in court proceedings perform not only a technical function, but also a human rights function, ensuring the eff ective participation of persons who do not speak the language of the proceedings. Judicial practice confi rms that the formal involvement of an interpreter does not guarantee fairness—the quality, accuracy, and eff ectiveness of the interpretation are decisive. The institution of court interpreting integrates the legal and communicative dimensions of procedural justice, affi rming the principle of equality of the parties and access to justice as a manifestation of “humane justice.”
